INVESTIGATION COMMITTEE
GUIDELINES FOR HEARINGS
PENNANT RULE 20.3

1.             Confirm match, reported player and umpires.  (PR 20.1, 20.7 & 20.9)

2.             The Investigation Committee Secretary to confirm that the hearing has been properly convened (PR 20.7) and that notice has been properly given to the player (PR 20.8) and the umpire (PR 20.10).

3.             If the reported player is not present and has submitted a reason for his absence, the Committee must determine whether to proceed with or postpone the hearing (PR 20.9).

4.             Acknowledge the Umpire’s Representative (PR 20.12) and any player representative (PR 20.13)

5.             Explain the procedure to be followed.

6.             Caution all parties as to the truthfulness of evidence.

7.             The Investigation Committee Secretary reads the terms of the Umpire’s Report (PR 20.1)

8.             The Committee asks the player whether the misbehavior is admitted or denied.  If admitted, the Committee proceeds immediately to 18, below.

9.             The Umpire’s Representative and the player (or representative) is asked whether they propose to call witnesses and, if so, the identity of those witnesses (PR 20.12).

10.         The witnesses, excluding the umpire, are requested to leave the hearing room.

11.         The Umpire’s Representative presents the case against the player by introducing witnesses, including the umpire.

12.         The player (or representative) may question each witness, including the umpire, after the witness has presented his evidence.

13.         The Committee may question the umpire or any witness at any time.

14.         The player (or representative) presents his case in defence, by introducing witnesses.

15.         The Umpire’s Representative may question each witness after the witness has presented his evidence.

16.         The Umpire’s Representative and the player (or representative) is invited to summarise their respective cases.

17.         All parties leave the hearing room while the Committee reaches a decision as to whether the player is guilty of misbehavior (PR 20.3)

18.         The Umpire’s Representative, umpires, player and player representative return to the room and the decision of the Committee is announced.

19.         Where the player is found to be guilty of misbehavior, the Committee enquires as to any previous misbehavior by the player.

20.         The player presents any witnesses or evidence, including character witnesses, in mitigation of the penalty.

21.         All parties leave the hearing room while the Committee reaches a decision on the penalty, which may consist of a reprimand, suspension or disqualification (PR 20.3).

22.         The Umpire’s Representative, umpires, player and player representative return to the room and the penalty is announced.

23.         The Committee completes the report sheets.
